Terms and Conditions

These Terms and Conditions govern your access to and use of the Harbourmetric website, practice tests, courses, memberships and related services.

By creating an account, purchasing a course, subscribing to a membership or using Harbourmetric, you agree to these Terms and Conditions. Online contracts can be accepted through actions such as making payment or clicking an agreement checkbox, but their terms cannot remove rights provided under the Australian Consumer Law.

1. About Harbourmetric

Harbourmetric Pty Ltd provides online certification practice tests, exam-preparation courses and digital learning services.

In these Terms:

Harbourmetric, we, us and our mean Harbourmetric Pty Ltd
You and your mean the person accessing or purchasing our services
Course means an individual Harbourmetric practice-test course
Membership means a Harbourmetric All Access monthly or yearly subscription
Content includes questions, answers, explanations, case studies, images, documents, course descriptions and other learning materials

2. Important Membership Information

The Harbourmetric All Access Membership is available as either:

Monthly All Access: A$4.99 per month, automatically renewing each month until cancelled
Yearly All Access: A$39.99 per year, automatically renewing each year until cancelled
Both plans give you access to the courses included in the membership library
Membership fees are charged using the payment method supplied during checkout
Memberships can be cancelled through the Manage Membership link on the Harbourmetric My Account page

Your subscription price, renewal frequency and cancellation terms will also be shown before payment. Important subscription renewal and cancellation conditions should be disclosed clearly and upfront rather than hidden within lengthy terms.

3. Account Registration

You may need to create a Harbourmetric account to purchase or access a course.

You agree to:

Provide accurate and current registration information
Maintain the security of your username and password
Keep your contact email address up to date
Notify us if you believe your account has been accessed without permission
Accept responsibility for activity carried out through your account where you have failed to protect your login details

Accounts are for individual use only. You must not share, sell, transfer or provide your account credentials to another person.

You must be at least 18 years old to make a purchase, or have the permission of a parent or legal guardian.

4. Individual Course Purchases

Individual courses are currently available for a one-time payment of A$4.99 per course.

An individual purchase gives the purchasing account access to that course for personal learning purposes, subject to these Terms.

Unless specifically stated otherwise:

The purchase is not a recurring subscription
Access is limited to the course purchased
Access cannot be transferred to another account
The purchase does not give access to all Harbourmetric courses
New courses are not automatically included

We may update, improve, replace or retire course material where reasonably necessary to maintain accuracy, quality, security or alignment with certification changes.

5. All Access Membership

The Harbourmetric All Access Membership provides access to the courses assigned to the membership library while the subscription remains active.

The membership includes:

Access to current courses included in the membership
Access to new courses added to the membership library
Practice-test results and progress tracking
Course explanations and supporting learning content

The inclusion of a particular course may change where an exam is retired, substantially replaced or no longer supported. Where reasonably possible, we will provide notice of material changes affecting active members.

Membership access is personal and cannot be shared with another person or organisation.

6. Recurring Payments

By purchasing an All Access Membership, you authorise Stripe and Harbourmetric to charge the applicable recurring fee — A$4.99 each month for Monthly All Access or A$39.99 each year for Yearly All Access — using your selected payment method until the subscription is cancelled.

You are responsible for ensuring that your payment details remain valid.

If a payment fails:

Stripe may retry the payment
Your membership access may be temporarily suspended
Access may be restored after successful payment
We may contact you regarding the failed payment

We will not continue charging for a period in which we are unable to provide the paid subscription service, except where the interruption is brief, outside our reasonable control or otherwise permitted by law.

7. Cancelling a Membership

You can cancel your membership through:

My Account → Manage Membership

Cancellation will normally take effect at the end of your current paid billing period. You will retain membership access until that date, after which:

Future payments will stop
Membership-provided course access will end
Courses purchased separately through one-time payments will remain available
Your learning account and historical results may remain available

You should cancel before your next renewal date to prevent the next charge.

8. Refunds

Refunds and billing disputes are governed by the separate Harbourmetric Refunds and Cancellations Policy, which forms part of these Terms.

We do not generally provide refunds for:

Change of mind
Failure to use a purchased course or membership
Changing or postponing your certification exam
Purchasing the wrong course where the course was accurately described
Failure to pass an external certification exam

This does not limit any right or remedy available under the Australian Consumer Law. Consumer guarantees apply automatically and cannot be excluded through a business policy or contractual term.

9. Certification and Exam Disclaimer

Harbourmetric provides independent exam-preparation and educational content.

We do not guarantee that:

You will pass an official certification exam
Questions on an official exam will match Harbourmetric questions
An exam provider will accept or approve your preparation method
A certification will result in employment, promotion or increased income
Every course will remain aligned after an exam provider changes its curriculum

Your results depend on factors including your knowledge, experience, study effort and performance during the official exam.

Harbourmetric does not provide or distribute confidential exam questions, examination dumps or unlawfully obtained certification content.

10. Independent Training Provider

Harbourmetric is an independent training provider and is not affiliated with, endorsed by or sponsored by Microsoft, Amazon Web Services, Google, CompTIA, PeopleCert, PMI, GitHub or other certification providers unless expressly stated.

Certification names, logos, product names and trademarks belong to their respective owners. They are used only to identify the certifications or technologies covered by our educational content.

11. Intellectual Property

Unless otherwise stated, Harbourmetric owns or licenses all intellectual property rights in its original content, including:

Practice-test questions
Answer choices
Explanations
Case studies
Course structures
Graphics and branding
Downloadable materials
Website content

Your purchase gives you a limited, personal, non-exclusive, non-transferable licence to use the content for your own learning.

You must not:

Copy or reproduce Harbourmetric content
Share questions or explanations publicly
Upload content to another website or learning platform
Resell or redistribute any course
Use automated tools to scrape or extract content
Use the content to create competing practice tests
Remove copyright or branding notices
Share screenshots, recordings or downloads beyond reasonable personal study use

This licence ends if your account is terminated for a serious breach of these Terms.

12. Acceptable Use

You must not use Harbourmetric to:

Break any applicable law
Attempt to access another person’s account
Interfere with the website or its security
Introduce malware, malicious code or automated attacks
Circumvent course-access or payment controls
Manipulate leaderboards, results or assessment records
Harass other users or Harbourmetric personnel
Use false payment, identity or registration information

We may investigate suspected misuse and take proportionate action to protect users, our systems and our intellectual property.

13. Suspension or Termination

We may suspend or terminate access where there is reasonable evidence of:

Account sharing
Payment fraud or chargeback abuse
Unauthorised copying or distribution
Attempts to compromise the website
Serious or repeated breaches of these Terms
Illegal or abusive conduct

Where appropriate, we will provide notice and a reasonable opportunity to address the issue. Immediate suspension may occur where necessary to protect customers, content, payment systems or website security.

Termination does not remove any rights you have under the Australian Consumer Law.

14. Course Availability and Updates

We aim to keep Harbourmetric available and its content accurate, but uninterrupted access cannot be guaranteed.

Access may be temporarily affected by:

Maintenance
Hosting interruptions
Security incidents
LearnDash or WordPress updates
Stripe outages
Internet or network failures
Events outside our reasonable control

We may correct errors and update course content as certification objectives, technologies and official documentation change.

Where an interruption materially prevents you from accessing a paid service, contact us so we can investigate and provide an appropriate remedy where required.

15. Third-Party Services

Harbourmetric uses third-party providers to operate parts of its service, including:

Stripe for payment processing and subscription management
LearnDash for course delivery and learner access
WordPress and website-hosting providers
Email and analytics services

Your use of these features may also be subject to the relevant provider’s terms and privacy practices.

Harbourmetric does not directly store complete payment-card details. Payment information is submitted to and processed by the payment provider.

16. Privacy

Your personal information is handled in accordance with the Harbourmetric Privacy Policy.

This may include your:

Name
Email address
Account details
Course enrolments
Quiz attempts and results
Payment and transaction references
Website activity
Support communications

Organisations covered by the Privacy Act must publish a privacy policy explaining in plain language how personal information is handled. Some small businesses are exempt, although particular business activities can still bring them within the Act.

17. Communications

We may send transactional communications relating to:

Account registration
Purchases and receipts
Password resets
Subscription renewals or failures
Course access
Security and service notices
Support requests

Marketing communications will be managed separately, and you may unsubscribe from promotional emails using the link provided.

18. Reviews and Testimonials

Reviews must reflect genuine experiences.

You must not submit content that is false, misleading, defamatory, abusive or unrelated to your experience with Harbourmetric.

We may moderate or remove reviews that breach these requirements, but we will not remove a genuine negative review merely because it is critical. Businesses must not create or arrange fake or misleading online reviews.

19. Liability

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded.

To the extent permitted by law, Harbourmetric is not responsible for:

Certification exam fees
Failed examination attempts
Employment or career decisions
Loss caused by sharing account credentials
Problems caused by unsupported devices, browsers or internet connections
Third-party platforms outside our reasonable control
Indirect or consequential loss that was not reasonably foreseeable

Where our services fail to meet a consumer guarantee, the remedies available will be those required under applicable law.

20. Complaints and Disputes

Please include:

Your name
The email used for your account
The relevant course or membership
Your payment or order reference
A clear explanation of the problem
Any supporting screenshots

We will review the matter and respond within a reasonable period.

Nothing in this section prevents you from exercising any legal right or contacting an applicable consumer-protection body.

21. Changes to These Terms

We may update these Terms to reflect changes to:

Our products or pricing
Payment or membership systems
Website functionality
Certification offerings
Security requirements
Applicable laws

Material changes will apply prospectively and will be communicated reasonably where they significantly affect an existing paid membership.

The version displayed on the Harbourmetric website will be the current version.

22. Governing Law

These Terms are governed by the laws of New South Wales, Australia.

You and Harbourmetric submit to the courts and tribunals having jurisdiction in New South Wales, subject to any rights you may have under applicable consumer law.
